Terms of Service.

This site and the services behind StrataWx are operated by StrataSim Designs LLC, a Utah limited liability company ("StrataSim", "we", "us"). Full company details are on the legal page.

Using this site or the services means you accept these Terms. If you do not accept them, do not use them.

These Terms cover this website and the online services the app depends on: licence validation, the weather service that supplies observations and model data, the update service, the customer portal, support, and our Discord server.

They do not cover the software on your machine. That is the End User Licence Agreement.

Polar is our merchant of record. When you buy through this site, your contract of sale for the payment is with Polar, who handle the card, the receipt and the sales tax. We supply the product and the licence.

Licences may also be sold through authorised resellers, including SimMarket and iniBuilds. Where you bought from a reseller, your contract of sale is with that reseller and their terms and refund policy govern the purchase. Your licence and your support are the same either way.

Prices are shown before you pay. Entitlements are per simulator, and what your purchase covers is stated at checkout and in your confirmation email.

Refunds: all sales are final on a digital download, with narrow exceptions. See the refund policy, which forms part of these Terms.

You normally have a 14 day right to withdraw from a distance contract. Because the product is delivered immediately, you are asked at checkout to consent to delivery starting at once and to acknowledge that doing so ends that right. That tick box is the only thing it does.

If you do not tick it, you keep the withdrawal right and delivery waits. Pre-orders are different: there is no immediate delivery, so no waiver is taken and the right is unaffected.

Your licence key and the email address you bought with are how we identify you. Keep them to yourself. You are responsible for activity under your licence. Tell us through Support if you believe your key has been shared or taken.

The customer portal signs you in by emailing a link. There is no password to lose.

The weather service and licence API exist to serve the app on your machine. You may not:

• access them other than through the Software, or automate, scrape or bulk-harvest them;
• redistribute, resell or proxy the data we serve, or use it to build a competing product or dataset;
• share, publish or trade licence keys, or use one licence to serve several people;
• attempt to bypass authentication, seat limits, rate limits or caching;
• probe, attack, overload or otherwise interfere with the services, or try to reach any part of them you are not authorised to reach.

We may rate limit, suspend or terminate access that breaches this section, and we may do it without notice where the service or other customers are at risk.

We run a Discord server for StrataWx. Joining it is optional, and it is not the support channel of record: a ticket through Support is. Discord's own terms apply to you there in addition to these, and we may remove content or remove a member from the server at our discretion.

Screenshots posted in that server are used to advertise StrataWx. A shot of real weather in the sim is the best advertisement the product has, so we would rather state this plainly here than bury it. When you post a screenshot, video, clip or other image in our Discord server:

• It stays yours, and it also becomes ours. You keep your own rights in it and may use or post it anywhere else you like. You also grant StrataSim Designs LLC ownership of it jointly with you and, to the extent that grant is not effective where you live, a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable licence to use it. Either route gives us the two rights below.
• We may use it to promote StrataWx. On this website, on store and reseller pages, on social media, in trailers and videos, inside the app, in press material and in paid advertising. Whole or cropped, resized, colour corrected, or composited with our branding and text.
• We do not have to ask you or tell you. No prior notice, no approval step, no credit and no payment. If you want a credit, ask us and you will usually get one, but it is not owed.

By posting, you confirm the image is yours to give: that you captured or made it, and that you are not passing on somebody else's work. If it turns out you were not entitled to grant this, tell us and we will stop using it.

Two limits we hold ourselves to. We will not use an image to claim something the image does not show, and if you ask us to stop using a particular one we will drop it from new material where we reasonably can. What is already published cannot be recalled, whether it is in print, in a video, or on somebody else's page.

If you would rather your screenshots were not used this way, do not post them in the server. Nothing about your licence, your support or your account changes if you never post at all.

We do not promise uptime. These are consumer services provided without a service level agreement. They may be unavailable for maintenance, for reasons upstream of us, or because a third-party weather provider is down. We aim to keep them running, and we will not pretend that amounts to a guarantee.

The app is built to degrade rather than fail: where one data source is unavailable it falls back to another. That is a design goal, not a warranty.

The weather service relays observations and model data from third parties, credited on the legal page. We do not originate that data and cannot warrant its accuracy, completeness or availability. It is supplied under their terms.

We may add, change or withdraw parts of the services. Where a change would materially reduce what a current licence gives you, we will give reasonable notice through the app, this site or email.

We may suspend or terminate access for breach of these Terms or the Licence, for fraud, or where a payment is reversed or charged back. You can stop using the services at any time; to have your data deleted, see the Privacy Policy.

To the fullest extent permitted by law the site and services are provided "as is" and "as available", with no warranty of any kind. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profit or goodwill.

Our total aggregate liability arising out of or relating to the site and the services is limited to the amount you actually paid us in the twelve months before the claim arose.

Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded, and nothing here removes a mandatory consumer right that applies where you live.

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law rules, with venue in the state and federal courts located in Utah.

If you are a consumer resident in the EU, the EEA or the UK, you may also bring proceedings in your country of residence, and mandatory local consumer protections continue to apply.

We may revise these Terms. The current version is always the one published here, and the revision date in the document block above says when it last changed. Material changes will be signposted rather than slipped in.
